Terms of Service

1. Acceptance of Terms

By accessing or using Outgi ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may modify these terms at any time; continued use constitutes acceptance.

2. Description of Service

Outgi is a B2B outreach automation platform enabling users to reach prospects via email, contact forms, LinkedIn, WhatsApp, SMS, AI voice calls, and direct mail — all from a single dashboard, with AI-assisted message generation, reply tracking, CRM, and analytics.

3. Acceptable Use & CASL Compliance

You agree to use the Service only for lawful outreach across all available channels. You must comply with all applicable laws including CAN-SPAM, GDPR, CASL (Canada's Anti-Spam Legislation), TCPA, and PIPEDA. Specific CASL obligations: (a) you must have express or implied consent before sending commercial electronic messages to Canadian recipients; (b) every commercial message must clearly identify you as the sender with accurate contact information; (c) every message must include a functioning unsubscribe mechanism honoured within 10 business days. Outgi provides the unsubscribe mechanism and processes opt-outs automatically. You are responsible for ensuring your contact lists have the required consent basis. You may not send spam, deceptive messages, robocalls without consent, or target consumers without a lawful basis.

4. Account Responsibilities

You are responsible for all activity under your account. Do not share login credentials. Notify us immediately at support@outgi.com of any unauthorized access. We are not liable for losses from unauthorized use.

5. Payment and Subscriptions

Paid plans are billed in advance monthly or annually. Fees are non-refundable except as required by law. Accounts with overdue payments may be suspended. Plan limits (domains, senders, targets) are enforced per your tier.

5a. Data Processing Agreement

Outgi processes personal data (contact names, emails, company info) as a data processor on your behalf. You are the data controller for all imported contact data. By using the Service, you represent that you have a lawful basis to send commercial messages to each contact. All data is stored on servers in Canada. For EU/EEA contacts, you are responsible for ensuring your use of Outgi complies with GDPR. We provide Standard Contractual Clauses (SCCs) and a Data Processing Agreement (DPA) on request: support@outgi.com.

6. Intellectual Property

Outgi and its features are owned by Outgi Inc. and protected by applicable IP law. You retain ownership of content you create using the Service.

7. Termination

We may suspend or terminate accounts for Terms violations at any time. Upon termination, access ceases immediately. Data is retained for 90 days after account closure then deleted.

8. Limitation of Liability

The Service is provided "as is" without warranties. To the maximum extent permitted by law, Outgi is not liable for indirect or consequential damages. Our total liability shall not exceed amounts paid in the prior 12 months.

9. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
